Agreement to terms

By accessing or using PassportAlerts ("the Service"), operated by Monza Labs, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Description of service

PassportAlerts is a notification service that monitors the USPS Retail Customer Appointment Scheduler (RCAS) for passport appointment availability. When we detect an available appointment near your selected locations, we send you a notification via email or SMS.

PassportAlerts is a notification-only service. We do not book, reserve, hold, or guarantee any appointments on your behalf. All appointment bookings must be made directly through the USPS website. Appointment availability is subject to change at any time and a notification does not guarantee that a slot will still be available when you attempt to book it.

Not affiliated with USPS

PassportAlerts is an independent service and is not affiliated with, endorsed by, sponsored by, or connected to the United States Postal Service (USPS), the U.S. Department of State, or any government agency. "USPS" and related trademarks are the property of the United States Postal Service.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using PassportAlerts, you represent that you meet these requirements.

Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary. You must notify us immediately if you become aware of any unauthorized use of your account.

Subscriptions and payments

PassportAlerts offers both free and paid subscription plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

You may cancel your subscription at any time through your account settings or Stripe's Customer Portal. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial months, but you will retain access to paid features until the end of the period you have already paid for.

Acceptable use

You agree not to: use the Service for any unlawful purpose; attempt to interfere with, compromise, or disrupt the Service; create multiple accounts to circumvent rate limits or abuse free tier features; resell, redistribute, or commercially exploit the notifications or data provided by the Service; use automated tools (bots, scrapers) to access or interact with the Service; or impersonate another person or entity.

We reserve the right to suspend or terminate your account if we determine that you have violated these terms.

SMS and email communications

By providing your phone number and subscribing to SMS alerts, you consent to receive text messages from PassportAlerts related to appointment availability. Message frequency varies based on appointment availability and your plan settings. Message and data rates may apply. You can opt out of SMS alerts at any time by replying STOP or adjusting your notification preferences in your account settings.

By providing your email address, you consent to receive appointment alert emails and service-related communications. You can unsubscribe from marketing emails at any time, but transactional emails related to your account and service may still be sent.

Service availability

We strive to keep the Service operational, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including changes to the USPS appointment system). We are not liable for missed notifications or appointments that become unavailable before you can book them.

Limitation of liability

To the maximum extent permitted by law, Monza Labs, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Service.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be timely, or be free of errors.

Changes to terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date above. Your continued use of the Service after any changes constitutes acceptance of the new terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina.
